Montoya pleads guilty

Julian Montoya pleaded guilty to a Class C Felony of negligent homicide of a child victim, and Class B Felony for duty in an accident involving injury or death during his change of plea hearing and sentencing on Monday, Sept. 25 at the McKenzie County Courthouse.
Montoya was charged with the death of a six year-old boy, who was identified by family as Ian Matteo Garcia Turcios, who went by  Matteo.
The incident took place the evening of April 8 when Matteo, his father, and his brother were spending time outside near their garage.
Matteo was riding his bike when Montoya struck him at a high rate of speed, killing him. Montoya left the scene of the accident before returning after the police arrived.
In their victim impact statement, Matteo’s family told the court of the devastating effect this had on Matteo’s family.
Montoya was sentenced to serve ten years imprisionment, with five years  suspended, and credit for 168 days already served. He is to have no contact with the victim’s family.
